Terms and conditions
1. Who I am
These terms are an agreement between you and Fineupp, a sole proprietorship of Kevin Keller, John Deelaan 26, 2135 XA Hoofddorp, the Netherlands, KvK 91339448, VAT ID NL004887547B98, which provides eutonomous ("I", "me"). You can reach me at hello@eutonomous.eu.
2. What these terms cover
They apply to eutonomous.eu and the services offered under it: the inference API, AI workspaces, compute boxes, the client-side runtime and the console. eutonomous is still being built. Services may be unavailable, change or be offered only to invited users until launch; what is available to you is shown when you sign up or pay.
3. Your account
- You must be at least 18, and give correct details. If you sign up for an organisation, you confirm you may act for it.
- Keep your password and API keys secret. Requests made with your keys count as yours. Revoke a key in the console as soon as you think it has leaked.
4. Prices and payment
- Prepaid balance. Inference is paid from a prepaid balance. A top-up adds the amount you pay to your balance. Each request is charged at the provider's own price per token, with no margin added; the prices are listed in the console and on the sovereignty ledger. When the balance runs out, requests stop until you top up. Your balance does not expire.
- Subscriptions. Paid plans and seats are billed monthly in advance. You can cancel at any time; the plan then ends at the end of the period already paid.
- The price and what is included are shown before you pay. Payments are processed by Stripe or Mollie.
5. Right of withdrawal (consumers in the EU)
Prepaid balance. If you are a consumer, you can withdraw from a top-up within 14 days without giving a reason. I then refund the part of that top-up you have not used yet (at most your current balance). What you have already used is not refunded — by using it you asked me to deliver that part right away, so your right of withdrawal ends for it.
Subscriptions. You can withdraw from a subscription within 14 days of taking it out. If you used it during that time, you pay a proportionate amount for the days used.
How to withdraw. Send me a clear statement by email or by post (addresses above). You can use the model form below, but you don't have to. I refund you within 14 days of receiving your withdrawal, using the same payment method, at no cost to you.
If you use the services for your business, there is no right of withdrawal.
6. Acceptable use
Do not use the services to break the law or other people's rights, to create or spread illegal content, to attack or overload systems (including these services), to get around their security or limits, or to resell access without my written agreement. The model providers' own use policies also apply to requests sent to them.
7. Your content and AI output
- You keep all rights to what you send, upload or build. You give me permission to process it only as far as needed to provide the services to you. I do not use it to train models.
- AI output can be wrong, incomplete or similar to other people's work. Check it before you rely on it; you are responsible for how you use it.
- If you publish content through the services (for example an app), you are responsible for it. I may remove content that is illegal or breaks these terms, and I tell you why.
8. Availability
I work to keep the services running and secure, but cannot promise they are always available, especially while they are being built. Planned maintenance is announced where possible.
9. Liability
- Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be limited by law.
- If you are a consumer, your statutory rights apply in full.
- If you use the services for your business, my liability is limited to the amount you paid me for eutonomous in the 12 months before the event, and I am not liable for indirect damage such as lost profit or lost data.
10. Ending the contract
- You can close your account at any time. On request I refund an unused prepaid balance, minus any amount still owed.
- I may suspend or end your access if you seriously or repeatedly break these terms or the law. I tell you why. If I end a service without such a reason, I refund your unused balance and the unused part of a subscription.
11. Changes to these terms
I may update these terms. For changes that affect you, I email you at least 30 days before they take effect. If you don't agree, you can close your account before then and I refund your unused balance. Changes never apply to payments already made.
12. Complaints and applicable law
- Complaints: email me and I will reply as soon as possible.
- Dutch law applies. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of your country, and you can bring a claim before the courts where you live.
